The District Attorney’s Office has the discretion to accept or deny your request for a guilty plea by email. If your case is accepted for a plea by mail it may be possible to resolve your case without having to appear in court. After your case is accepted for a plea by email, you will receive an email from SignNow.com, an online electronic signature service. THE PLEA BY MAIL PROCESS MAY TAKE UP TO SEVERAL WEEKS FROM THE DATE THE REQUEST IS RECEIVED IN THE DISTRICT ATTORNEY’S OFFICE TO THE TIME THE COURT ACCEPTS THE PLEA OFFER. IF THERE IS A PENDING COURT DATE IN YOUR CASE IT IS YOUR RESPONSIBILITY TO APPEAR AT THE COURT DATE OR MAKE SURE THE COURT DATE IS CONTINUED. FAILURE TO DO SO MAY RESULT IN A WARRANT FOR YOUR ARREST FOR FAILING TO APPEAR IN COURT.
What types of cases are eligible for Plea by email?
Most Misdemeanor and traffic cases. Felony cases are not eligible. You must appear for your advisement date on your court summons before you can apply for a plea by email. Requests for a plea by email made before your first court appearance cannot be responded to.
What information should I include with my request for a plea by email?
State why you believe you are eligible for a possible reduced plea agreement and any extenuating circumstances you believe the district attorney’s office should take into consideration when determining a plea offer. Also, attach any documentation you believe is relevant, such as proof of insurance, vehicle registration, or proof of eligibility to obtain a license to drive in Colorado. You should attach a copy of your ticket if you have one.
What happens if my plea by mail is accepted?
If your application is accepted, you will be emailed a plea offer from the District Attorney’s Office. If you wish to accept the plea offer you will need to review the paperwork via the SignNow application. After your case is accepted for a plea by email, you will receive an email from SignNow.com, an online electronic signature service. What happens after I sign my plea paperwork?
Please keep in mind it may take several weeks to fully process your plea. Once you receive and electronically signed your plea paperwork, a court clerk will contact you with information on how to finalize your plea agreement and pay any applicable fines or court costs.

What happens if my plea by email application is denied?
You will be notified by our office that your plea by mail is denied. If your case is not accepted you will need to appear in court as scheduled.
What if my plea by email was accepted but I have questions about the plea agreement?
A Deputy District Attorney will be available to speak with you about your case during your next scheduled court appearance. If you have questions about your case the easiest way to speak with a Deputy District attorney is by waiting until your next scheduled court appearance. Unless the Court tells you otherwise, you must appear on your scheduled court dates or a warrant may issue for your arrest.
How long will the plea by email process take?
It can take several weeks from the date your request is received in our office. If you do not receive a response you must appear for your next scheduled court appearance. How do I speak to a Deputy District Attorney about my case or about a potential plea agreement?

What are my rights?
The Court will give you an advisement as to the charges you are facing on your first court appearance in the First Appearance Center. You cannot request a plea by email until after you attend that initial advisement. You do have the following rights:
- - The right to plead not guilty.
- - The right to a speedy and public jury trial.
- - The right to representation by a lawyer before trial and at trial.
- - The right to see, hear and face in open court all witnesses called to testify against me and to cross-examine them.
- - The right to have the prosecution prove each element of each offense charged in this matter beyond a reasonable doubt.
- - The right to remain silent.
- - The right not to testify.
What if I have not heard from your office before my court date?

What is my case number?
Your case number is the court’s docket number. It is not the same as the number on your ticket. You may contact the court at 719-452-5500 to obtain your case number. What is my citation number?
That is the number that is imprinted on your summons. It can sometimes be located on the top right-hand side of your summons.

I have Court today in the first appearance center but there is a long wait in the WebEx.
Due to the current pandemic wait times may be unusually long. You may have to wait in the lobby of the WebEx for an extended period before you are admitted into the Webex Meeting. Please do not leave the lobby of the meeting as your court appearance is called in the order you entered the meeting. Wait times of an hour or even more are not uncommon.
How do I reschedule my next court appearance?
The DAs Office cannot reschedule Court appearances. You must call the FAC at 719-452-5500 to reschedule a court appearance. If you do not appear for your court appearances a warrant may be issued for your arrest.
